Attach copy of DL, and copy of recent utility bill (with current address) Write letter to each agency that has data you want to challenge like this: To Whom it May Concern, The following debt is not mine. Reference report number, reference item number and sign it. Send letter and copies of doc’s certified return receipt (USPS) – cost is $4.64 each.

    Ahhh…..if it was only as easy as KH says it is.

    If it was that easy, they wouldn’t have had to pass the Fair And Accurate Credit Reporting Act a few years ago.

    The reason you are having problems is because you don’t know the law. So let me try and guide you through this. I’ve been there, and have helped many others do it.

    It’s very important to keep accurate records of you you write/talk to, send all letters certified mail/return receipt, and FOLLOW THE PROCEDURES!

    The key is to remember this: There are only two ways a negative item can be removed from your credit report.

    1) The creditor must remove it
    2) The creditor fails to respond to a dispute investigation from the credit bureau.

    So you can cuss and scream all you want at the credit burear, it’s not their fault. They only report what creditors tell them. What you have to do is first dispute this with the CREDITOR/COLLECTION AGENT…..then if it’s still being reported sue them.

    Suing them for violation of the Fair Credit Reporting Act is easy to do. It’s a small claims suit that only costs $25-$50, does not require a lawyer, and if you win you can win civil damages of $1000 plus whatever damages this report has caused you (loss of credit, higher interest rates, etc….).

    Look at it as winning the lottery. I won $1200 because a collection agent wanted to be a jerk about an incorrect report, and it cost him!
