I have a friend who I believe is telling a very tall tale. She claims that the reason so many people are trying to process serve her over finances is because her mother stole her identity years ago and used her info to run up credit. My friend is now saying she is going to file bankruptcy to make it go away. If this was identity theft, would bankruptcy really be necessary because it sounds like bs to me. Thoughts?

No….if it was identity theft she can fix it. Now I am not saying it will be easy but she can fix it……since she knows who did it she may have to turn her mother in. That could be the issue at hand…..she doesn’t want to tell on her mom. The creditors will want their money if it is known who actually created it….
There really is a lot going on there. Does she have proof? What was her credit like prior to this. She really should seek and attorney to sort through it all.

if she didn’t open the accts, she shouldn’t be liable for them. She may have to file chap 13, which will NOT discharge all the debt – she would still have to pay most it not all of it off on a court ordered payment plan – if she’s telling the truth, she should get legal help to get the debts removed from her name
